Navigating Longevity: Solutions for Aging Charitable Life Estate Gifts

  • Elizabeth Bawden, Withers, Partner

As life expectancies increase, donors who gifted their homes to charity while retaining a life estate and have lived longer than expected are more frequently approaching those charities for solutions as they face changing needs for housing, cash, and other changes in circumstances. This presentation will explore strategies for charities working with these donors. It will cover financial solutions such as converting life estates into current gifts, leasing the property for income, and selling the property in collaboration with the donor, as well as many of the tricky non-financial issues and risks that commonly arise for charities navigating these situations.

Elizabeth is a philanthropy attorney whose mission is to guide individual and charitable clients through complex wealth transitions with advice that is clear, creative and enduring. As a partner in the trust, estate and charities team at Withers Bergman LLP, she specializes in crafting tailored strategies that address a wide range of estate planning needs and assisting individuals and organizations in establishing meaningful charitable foundations, structuring major and planned gifts, and navigating the complexities of charitable giving. Elizabeth is a past-president of SCCGP, faculty in the American Institute for Philanthropic Studies Certified Specialist in Planned Giving Program and was recently recognized by the Los Angeles Business Journal as a leader of influence in nonprofit and philanthropy.

Session 2

Building Stronger Communities: The Power of Foundations, and Advisors Working Together

  • Emily Stork, JD, Senior Planned Giving Officer, California Community Foundation
  • Fernando Sanchez, CFP®, EA, Manager, Wealth Management, Aspiriant

This presentation will explore the collaboration between community foundations and professional advisors to support the alignment between nonprofit organizations' needs and donors' philanthropic passions.

Emily and Fernando explain how community foundations operate and then focus on the synergistic relationship between community foundations and advisors. They'll discuss how these partnerships form, the roles each party plays, and the unique value they bring to the table. The presentation delves into how advisors work alongside community foundations to guide donors in making informed giving decisions and maximizing the impact of charitable contributions. This collaboration not only benefits donors but also amplifies the overall positive effect on the community. We’ll showcase case studies on how this partnership model enhances philanthropic efforts and strengthens communities. The aim is to inspire a deeper understanding of how foundations and advisors can work together effectively to drive meaningful change.

Fernando is a wealth manager with Aspiriant who works with ultra-high-net-worth families within the Exclusive Family Office Group. He advocates for a client-first approach and finds great joy in helping clients connect their wealth to their vision, values, and goals through comprehensive financial and charitable planning. In addition to his involvement with SoCal CGP, he is on the board of directors for the Opera League of Los Angeles, serving as Treasurer and a member of the finance and strategic planning committees. He earned a Bachelor of Science in mathematics and economics from the University of California, San Diego, and graduated from the personal financial planning program at UCLA. Fernando is a CERTIFIED FINANCIAL PLANNER™ professional and an Enrolled Agent, the highest credential the Internal Revenue Service awards.

As Planned Giving Officer, Emily Stork leads CCF’s Sartori Circle program, which recognizes and brings together donors of testamentary gifts who have decided to make a long-term impact on the lives of others through their charitable bequests. Emily works closely with donors during their lifetimes to ensure their bequests, whether they include gifts of real estate, closely-held stock or other gifts of cash or complex assets, fulfill donors’ philanthropic visions for supporting the causes they care about the most. Emily also promotes CCF’s gift planning services by developing and deepening relationships with donors, advisors, and nonprofits.

Prior to joining CCF, Emily served as the Director of Development for The ALS Association Golden West Chapter. In that position, she expanded the Chapter’s planned giving, major gifts, and annual fund programs. Her interest in planned giving began when she worked for her alma mater, Mount Holyoke College, as a Major Gift Officer. Emily brings over eleven years of fundraising experience, a legal background, and a love for Los Angeles and its diverse communities to this position.

Emily earned her Bachelor of Arts degree from Mount Holyoke College in International Relations and Spanish and her Juris Doctorate from Loyola Law School. After college, Emily was awarded a Fulbright Fellowship to study in Argentina.
